Namaste’ AKay One Love Design is dedicated to bringing transparency and holds privacy to the highest of standards.  Unless stated otherwise below, the provision of your personal data is neither legally nor contractually obligatory, nor required for conclusion of a contract, or acquirement purchase. You are not obliged to provide your data.  

At AKay One Love Design (“us,” “our,” or “we”), we recognize that your privacy is important – both to you and to us. AKay One Love Design is also committed to the fair and transparent processing of our customers’, consumers’ and website visitors’ personal information (“Personal Information”). We also strive to ensure that you have the greatest possible control over your information. 

Not providing your data will have no consequences. This only applies as long as the processing procedures below do not state otherwise. 

"Personal data" is any information relating to an identified or identifiable natural person. 

Server log files 

You can use our websites without submitting personal data. 

Every time our website is accessed, user data is transferred to our us and our web host/IT service providers by your internet browser and stored in server log files. This stored data includes for example the name of the site called up, date and time of the request, the IP address, amount of data transferred and the provider making the request. The processing is carried out on the basis of Article 6(1) f) GDPR due to our legitimate interests in ensuring the smooth operation of our website as well as improving our services.

Proactive contact of the customer by e-mail 

If you make contact with us proactively via email, we shall collect your personal data (name, email address, message text) only to the extent provided by you. The purpose of the data processing is to handle and respond to your contact request. 

If the initial contact serves to implement pre-contractual measures (e.g. consultation in the case of purchase interest, order creation) or concerns an agreement already concluded between you and us, this data processing takes place on the basis of Article 6(1)(b) GDPR. 

If the initial contact occurs for other reasons, this data processing takes place on the basis of Article 6(1)(f) GDPR for the purposes of our overriding, legitimate interest in handling and responding to your request. In this case, on grounds relating to your particular situation, you have the right to object at any time to this processing of personal data concerning you and carried out on the basis of Article 6(1)(f) GDPR. 

We will only use your email address to process your request. Your data will subsequently be deleted in compliance with statutory retention periods, unless you have agreed to further processing and use.

Customer account 

When you open a customer account, we will collect your personal data in the scope given there. The data processing is for the purpose of improving your shopping experience and simplifying order processing. The processing will be carried out on the basis of art. 6 (1) lit. a GDPR with your consent. You can withdraw your consent at any time by contacting us without affecting the legality of the processing carried out with your consent up to the withdrawal. Your customer account will then be deleted. 

Collection, processing, and transfer of personal data in orders 

When you submit an order, we only collect and use your personal data insofar as this is necessary for the fulfilment and handling of your order as well as processing of your queries. The provision of data is necessary for the conclusion of a contract. Failure to provide it will prevent the conclusion of any contract. The processing will occur based on Article 6(1) b) GDPR and is required for the fulfilment of a contract with you. 

Your data is transferred here, for example through payment service providers WIX Payments and so forth, to service providers for handling the order and to IT service providers. We will comply strictly with legal requirements in every case. The scope of data transmission is restricted to a minimum. 

As an added layer of security and privacy AKay One Love Design in the creation of our website selected the highest security and privacy standards possible and we are only able to view information that is absolutely vital and necessary. We only have access to view the last 4 digits of any Credit or Debit card number, all other information, for example a Credit or Debit Card and CVV Number is encrypted when you enter it, and hidden and we would need additional exclusive permissions from you to receive this information.  

Data collection when you post a comment. 

When you comment on an article, blog post, or a contribution, we collect your personal data (name, email address, comment text) only in the scope provided by you. The processing serves to allow you to comment and to display comments. By submitting the comment, you agree to the processing of the transmitted data. The processing will be carried out on the basis of art. 6 (1) lit. a GDPR with your consent. You can withdraw your consent at any time by contacting us without affecting the legality of the processing carried out with your consent up to the withdrawal. Your personal data will then be deleted. 

On publication of your comment only the name you have entered will be published. 

Use of your email address for e-mailing of newsletters, updates on products, promotions, blog posts, and other marketing  

Namaste’ as with many other websites, we use your email address outside of contractual processing exclusively to send you email updates on products, promotions, updates on blog posts, and our monthly newsletter for our own marketing purposes (which you may opt out of at any time). The processing will be carried out on the basis of art. 6 (1) lit. a GDPR with or without your consent. You can withdraw your email at any time without affecting the legality of the processing carried out with your consent up to the withdrawal. You can unsubscribe from any emails sent at any time using the relevant link in the email or by contacting us. Your email address will then be removed from the list. 

Your data will be not be forwarded to a service provider for email marketing in the course of order processing.  

Your email will never be sold or transferred. And your email will not be forwarded to other third parties, unless where outlined herein for fulfillment of an order. 

Our Website Host and Payment Process goes through WIX 

AKay One Love Design offers many way’s to checkout as a convenience to our guests.  However, our website host and our main payment processor is through our website host WIX.  Our payments are processed through WIX Payments.  Find below privacy information for WIX Payments as well as the other payment options we have available on our website.  

Standard Debit and Credit Card Purchases: 

The security of our users' sensitive data is of extreme importance to us here at AKay One Love Design and to our website Host WIX and together we are 100% committed to protecting it. 

Our website is PCI Compliant, ISO Compliant, and has TLS Certification through WIX Payments. 

The PCI DSS is an information security standard for organizations or companies that accept credit card payments. This standard helps to create a secure environment by increasing cardholder data, thus reducing credit card fraud. 

Wix is Payment Card Industry Data Security Standards (PCI DSS) compliant and is accredited as a Level 1 service provider and merchant. Wix’s PCI DSS compliance is assessed by an external company, and we are audited on a yearly basis in order to align with PCI standards. 

Wix PCI applications are running in a dedicated environment - with segregation from other product flows and servers - suitable for the highest PCI standards. 

Within WIX PCI environment, we maintain the highest standard of encryption and storage measures using a FIPS 140-2-certified HSM (Hardware Security Module). Our users’ data at rest encryption utilizes AES-256, the industry’s most broadly used encryption method.

TLS Certification 

Transport Layer Security (TLS) is a protocol that helps protect our online financial transactions by ensuring secure communication over a network 

The PCI Counsil states that any organization handling payment card transactions must use TLS 1.2 or higher in order to meet PCI DSS compliance standards. 

Wix uses Transport Layer Security and does meet PCI DSS compliance standards. 
We allow a minimum of TLS 1.2 so that out-of-date devices or browsers can access the website on your domain when they try to view it. At the same time, our sites allow the latest version of TLS for browsers which support it. 

Visitors with older browsers may be able to visit our website, however, if your older device protocols don’t meet PCI security standards, you may not be able to complete a transaction. 

 

Use of PayPal 

For the convenience of our guests, we offer the feature to pay using PayPal from your laptop or mobile device.

By selecting and using "PayPal Express", the data required for payment processing will be submitted to PayPal to execute the agreement with you using the selected payment method. The data is processed on the basis of Article 6(1)(b) GDPR.
